Avrupa hukuku h\u00fck\u00fcmlerinin yorumlanmas\u0131nda, sadece tam zamanl\u0131 bir \u00e7al\u0131\u015fan\u0131n normal \u00e7al\u0131\u015fma saatlerinin \u00fczerinde \u00e7al\u0131\u015f\u0131lan saatler i\u00e7in fazla mesai ek \u00fccreti \u00f6denmesini \u00f6ng\u00f6ren toplu s\u00f6zle\u015fme h\u00fck\u00fcmlerinin ge\u00e7erli olup olmad\u0131\u011f\u0131 konusunun a\u00e7\u0131kl\u0131\u011fa kavu\u015fturulmas\u0131 gerekmektedir. Bu durum a\u00e7\u0131k\u00e7a yar\u0131 zamanl\u0131 \u00e7al\u0131\u015fanlara kar\u015f\u0131 ayr\u0131mc\u0131l\u0131k te\u015fkil edecektir.<\/p>\n\n\n\n<p id=\"viewer-d9cu6\">Karara ba\u011flanan davada, yar\u0131 zamanl\u0131 olarak \u00e7al\u0131\u015fan bir hem\u015fire, \u00fclke \u00e7ap\u0131nda faaliyet g\u00f6steren bir diyaliz sa\u011flay\u0131c\u0131s\u0131na dava a\u00e7m\u0131\u015f ve tazminat talebinde bulunmu\u015ftur.<a href=\"https:\/\/www.gesetze-im-internet.de\/agg\/__15.html\"> \u00a7 B\u00f6l\u00fcm 15 (2) AGG<\/a> Ayr\u0131ca, \u00e7al\u0131\u015fma s\u00fcresi hesaplar\u0131nda fazla mesai nedeniyle ilave krediler.<\/p>\n\n\n\n<p id=\"viewer-etel4\">\u0130\u015f ili\u015fkisi i\u00e7in toplu i\u015f s\u00f6zle\u015fmesi ge\u00e7erlidir. Buna g\u00f6re, fazla mesai \u00fccreti yaln\u0131zca tam zamanl\u0131 bir \u00e7al\u0131\u015fan\u0131n \u00e7al\u0131\u015fma saatlerinin a\u015f\u0131lmas\u0131 durumunda sa\u011flan\u0131r.  <\/p>\n\n\n\n<p>\u0130\u015f Mahkemesi davay\u0131 reddetmi\u015ftir. Hessen Y\u00fcksek \u0130\u015f Mahkemesi (LAG), davac\u0131n\u0131n temyizi \u00fczerine i\u015f mahkemesinin karar\u0131n\u0131 k\u0131smen de\u011fi\u015ftirmi\u015f ve daval\u0131n\u0131n davac\u0131n\u0131n \u00e7al\u0131\u015fma s\u00fcresi hesab\u0131na gerekli saatleri yat\u0131rmas\u0131na h\u00fckmetmi\u015ftir. Davac\u0131n\u0131n di\u011fer temyiz ba\u015fvurusunu reddetmi\u015ftir. Davac\u0131 temyiz ba\u015fvurusunda, Genel E\u015fit Muamele Yasas\u0131'n\u0131n 15.2 maddesi uyar\u0131nca tazminat \u00f6denmesi talebini s\u00fcrd\u00fcrmeye devam etmektedir. Daval\u0131, temyiz ba\u015fvurusunun reddini ve \u00e7apraz temyiz yoluyla davan\u0131n t\u00fcm\u00fcyle reddini talep etmi\u015ftir.<\/p>\n\n\n\n<h2>Cinsiyet ayr\u0131mc\u0131l\u0131\u011f\u0131<\/h2>\n\n\n\n<p>BAG Sekizinci Senatosu, ATAD'dan, di\u011ferlerinin yan\u0131 s\u0131ra, Birlik hukukunun yorumlanmas\u0131na ili\u015fkin a\u015fa\u011f\u0131daki sorulara cevap vermesini istemektedir:<\/p>\n\n\n\n<p>Davac\u0131 ayr\u0131ca paragraf uyar\u0131nca tazminat talebinde bulunmu\u015ftur. <a href=\"https:\/\/www.gesetze-im-internet.de\/agg\/__15.html\">\u00a7 AGG Madde 15 paragraf 2 <\/a>dolayl\u0131 cinsiyet ayr\u0131mc\u0131l\u0131\u011f\u0131 gerek\u00e7esiyle dava a\u00e7m\u0131\u015ft\u0131r. MTV'nin 10. b\u00f6l\u00fcm, 7. paragraf, 2. c\u00fcmlesinde yer alan toplu s\u00f6zle\u015fme h\u00fckm\u00fcn\u00fcn uygulanmas\u0131yla tam zamanl\u0131 \u00e7al\u0131\u015fanlara k\u0131yasla yar\u0131 zamanl\u0131 bir \u00e7al\u0131\u015fan olarak kendisine kar\u015f\u0131 hukuka ayk\u0131r\u0131 bir \u015fekilde ayr\u0131mc\u0131l\u0131k yap\u0131ld\u0131\u011f\u0131 g\u00f6r\u00fc\u015f\u00fcndedir. Buna ek olarak, daval\u0131 \u00e7o\u011funlukla kad\u0131nlar\u0131 yar\u0131 zamanl\u0131 olarak istihdam etti\u011fi i\u00e7in, cinsiyeti nedeniyle dolayl\u0131 olarak dezavantajl\u0131 duruma d\u00fc\u015fm\u00fc\u015ft\u00fcr.<\/p>\n\n\n\n<p>ATAD \u015fimdi bu durumun, AB\u0130HA'n\u0131n 157. Maddesi ve 2006\/54\/EC say\u0131l\u0131 Direktifin 2. Maddesinin 1. F\u0131kras\u0131n\u0131n b bendi ve 4. Maddesinin 1. C\u00fcmlesi anlam\u0131nda tam zamanl\u0131 \u00e7al\u0131\u015fanlar ile yar\u0131 zamanl\u0131 \u00e7al\u0131\u015fanlar (kad\u0131n ve erkekler a\u00e7\u0131s\u0131ndan) aras\u0131nda e\u015fit olmayan muameleye yol a\u00e7\u0131p a\u00e7mad\u0131\u011f\u0131n\u0131 a\u00e7\u0131kl\u0131\u011fa kavu\u015fturacakt\u0131r.\u00a0<\/p>\n\n\n\n<p>\u0130\u015f Mahkemesi davay\u0131 reddetmi\u015ftir. Senato, ATAD'dan bu davada hangi hususun dikkate al\u0131naca\u011f\u0131n\u0131 \u00f6\u011frenmek istemektedir.
